Brief fact of the case is that one Ram Prasad Rai S/O Lt. Sher Bdr. Rai of Kamsi Forest Busty,Kalimpong called at P.S and produced a written information to the effect that on 07/12/18 midnight a hot altercation in between Paban Rai and his wife Junmani Rai on 08/12/18 morning complainant went to the house of Paban Rai to enquire about the altercation and found his daughter Junmani Rai Lying dead at on the floor in the house of Paban Rai.

              Over this written complaint the above noted case was started and SI.Shanker Dey was endorsed to investigation the case.

Order No.15 dtd.19.09.2019 that the convict Paban Rai is found guilty U/S 302 of the IPC and he is  sentenced to suffer rigorous imprisonment for life and pay a fine of Rs.500000/- in default to suffer further R/I for 02(two) years U/S 302 IPC.

GBN Ps Case No 12/16 dt 16/02/16 U/s 14(1) of Child Labour Prohibition and Regulation Act R/W 23 of Juvenal Justice ( Care and Protection Act

On 16/02/16 at 11:10 hrs one Pino lepcha and his team submitted an order sheet vide order no CWC/DRJ/29/16 dt.15/02/16. The Order sheet containing the direction to assist them from rescue child from their employee as a result ASI Sanjoy Chettri and police party left Ps for Mal Busty at the house of Bikash Pradhan to rescue minor child namely Susmita Orawn.

Order No 48 dt. 04/9/19 that the accuse person viz Bikash Pradhan is found guilty u/s 14(1) of Child Labour Prohibition and Regulation Act R/W 23 of Juvenal Justice ( Care and Protection Act. Accuse is liable to be convicted U/s 155 (2) Cr.P.C let the convict to be taken into custody. later; convict is produce before this court. Heard the convict in person on the point of sentence.

Hence, it is “ordered”

That the convict is here by sentence to imprisonment for three (3) months and fine of Rs 20000/- i.d, simple imprisonment of another seven (7) days.

Let it be known that on recovery of  the fine amount the entire amount thereof shall be made over to the victim of this case namely Sushmita Orawn as compensation under section 357 Cr.P.C.

Later, at this stage Ld Advocate files a petition with prayer for Bail on the ground stated therein on behalf of the accused Bikash Pradhan. Considered, accused Bikash Pradhan may find bail of Rs. 5000/- with one surety of like amount i.d toJC. To : 04/10/19 for appearance and report later Baild bond accordingly accepted. To date for appearance and report
